  1. Introduction
    This Website is managed and administered by BASCHILD S.R.L. (hereinafter called “BASCHILD” or “Data controller”). These provisions concerning privacy (Privacy Policy) define how BASCHILD treats the information received by the user via the Website.
  2. Personal data treatment
    Any requests for information or services made by the Website users may be subject to the insertion of personal data, whose treatment by BASCHILD, as Data controller, is in compliance with the european “Personal data protection code”, as per Legislative Decree no. 2016/679 (hereinafter called “Code”).
    The aim of this information notice is to make users aware of how BASCHILD treats their personal data. So it is necessary for the user to read this notice before entering his own personal data when sending requests via the Website.
  3. Aims of treatment
    According to the needs from time to time expressed by the user visiting any Website sections (and except for special rules and regulations for individual operations involving specific personal data, published from time to time on the Website), the aims of the personal data treatment are shown here below. The personal data (hereinafter called "Personal Data") are those directly entered by the users when filling in online forms and those acquired automatically (please see the section “Categories of Personal Data subject to treatment”).
    a) prior user consent and until revocation of the same, carry out marketing activities (such as, without limitation, sending promotional and advertising material) by email;
    b) in compliance with the legal requirements, to customize the user experience on the Website and improve the services and products offered by BASCHILD to its own customers, prior user consent and until revocation of the same, perform analysis on the habits or consumption choices and define the profile of the interested people by using the information provided by the latter when filling in the forms or according to any actions taken or information provided during the Website navigation;
    c) respond to user requests concerning BASCHILD products, advertising and Website (section “Contacts” of the Website);
    d) sending out newsletters to keep users abreast of the latest news on the Website, new products and other news about the world of BASCHILD;
    e) dealing with any complaints or remarks.
  4. Methods of treatment
    The Personal Data will be treated mainly electronically, with a logic strictly related to the aforementioned purposes.
  5. Nature and modalities of the provision of users Personal Data
    The provision of Personal Data is voluntary, but some Personal Data must be provided compulsorily (the data, whose fields are indicated by an asterisk) so that BASCHILD could meet the user needs. The partial or inaccurate provision of the Personal Data indicated by an asterisk or the refusal to provide them, makes impossible the provision of the service requested (since they are necessary for this purpose); whereas the partial or inaccurate provision of the optional Personal Data, or the refusal to provide them, have no consequences.
    The provision of Personal Data is done by filling out the appropriate fields on the Website sections. If the user has failed to give one or more compulsory data, a BASCHILD message of error appears, showing a list of compulsory Personal Data, that have been missed.
  6. Categories of Personal Data subject to treatment
    In addition to Personal Data conferred directly by the users (such as name, surname, address, email address, etc.), when connecting to the Website, computer systems and software procedures responsible for the Website functioning, administer and / or automatically and indirectly acquire some information which may constitute Personal Data, whose transmission is implicit when using Internet communication protocols (such as, by way of example but not limited to, the so called “cookies” (as further specified below), “IP” addresses, domain names of the computers used by the users to visit the Website, the “Url” notation addresses of requested resources, the time of the request to the server).
  7. Use of cookies
    Cookies are text lines acting as computer markers sent by a server (in this case, the server of the present Website) to the user device (generally the Internet browser) when it accesses a certain page of a Website; cookies are automatically saved by the browser of the user and transmitted to the server, that generated them, every time the user enters the same Internet page. In this way, for example, cookies allow and/or facilitate the access to some Internet pages in order to improve the user navigation, or they allow the storage of the visited pages and other specific information, such as the most frequently viewed pages, connection errors, etc. For this reason, for a facilitated and complete use of this Website, it would be better for the user to configure his own browser so that it accepts the receipt of such cookies.
    Often browsers are automatically set to accept cookies, but users can change the default configuration, in order to disable or delete cookies (from time to time or once for all), however with the consequence that the optimal use of some areas of the Website may be precluded.   8. Types and management of cookies
    a) Technical cookies:
    (i) Strictly necessary cookies: necessary for the navigation on a Website/web APP and the use of its functionalities, such as a proper display or the access to restricted areas. Therefore the disabling of these cookies will not allow such activities.
    (ii) Performance cookies: they anonymously collect information on the efficiency of the answers of a Website/web APP to user requests, only to improve the functionalities of the Website/Internet APP; for example which pages are the most frequently visited by the users, or if there have been any web pages errors or delays.
    (iii) Functionality cookies: they allow the Website/APP to remember user choices and propose them for subsequent accesses in order to provide better and customized services: for example, they can be used to propose contents that are similar to those already required by the user in the past.
    b) Targeting cookies: they are used to offer advertising that could be interesting for the users, according to the interests recognized during the navigation. They can be used for example to limit the passages of a specific ad, or to understand the effectiveness of a campaign according to the display frequency of the ad. These cookies can be also used by third parties, also on behalf of advertisers. The user can accept or refuse these cookies by expressing its consent (“opt in”) before the administration of them.
  9. Google Analytics
    This Website uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses "cookies", text files saved on the user computer to analyze how the users uses the Website. The information generated by cookies on the use of the Website made by the user will be transmitted to a Google server, where they will be stored. Google uses the information to analyze the Website use made by the user, prepare reports on the Website activities and provide the Website manager with further services, linked to the present Website and Internet use. The IP address transmitted by the user browser with Google Analytics will not be associated with further data owned by Google. The user can prevent the storage of cookies by changing the software settings of his own browser, but this could prevent you from fully use all the functions of this Website.     When visiting the Website, the user gives his consent to the processing of his own data by Google for the modalities and the purposes specified above.
  10. Cookies opt-out
    The rules on Personal Data protection state that the user can opt-out cookies already administered. The opt-out procedure applies for the so called “technical cookies” (art. 122 of the Code), and cookies that do not fall within “technical cookies” previously accepted (“opt in”) by the user.
    By virtue of this distinction, the user can opt-out and/or delete cookies (“opt-out”) by using his own browser settings and opt-out and/or delete specific and non technical cookies administered by third parties by entering (for European Union residents), the website managed by the European Interactive Digital Advertising Alliance (EDAA) at the address www.youronlinechoices.eu or by entering (for USA residents) the address www.aboutads.info/choices/. These websites are not managed by BASCHILD, that does not assume responsibility for their contents.
  11. How to enable or disable cookies on his own browser
    The user can prevent the navigation browser from the acceptance of cookies. However this procedure can prevent the proper performance of certain web pages. Below are the methods offered by the main browsers to block the acceptance of navigation cookies:

  12. Categories of persons who may become aware of users Personal Data
    Personal Data may be brought to the knowledge of employees and collaborators of the Data Controller offices who, working under the direct authority of the latter, are appointed responsible for or in charge of treatment in accordance with the Articles 29 and 30 of the Code, and who will receive adequate operating instructions about it; the same will be done by the supervisors appointed by the Data Controller towards their own employees or collaborators.
  13. Communication or dissemination area of user Personal Data
    The Personal Data provided by the users will not be disclosed to third parties.
  14. Data Controller and data supervisors
    The Data Controller is BASCHILD S.R.L., based in Treviolo, Via degli Assini n.14/16/18 – 24048.
    Some data supervisors are:
    a) The Rocket Science Group, LLC d/b/a MailChimp, based in Atlanta, GA, 675 Ponce de Leon Ave NE, Suite 5000, 30308, for the management of the database containing the email addresses collected by BASCHILD through spontaneous sending by the users;
    b) Sfera Networks S.R.L., based in Treviolo, Via delle Querce n.7 - 24048, with regard to the management of the server on which the Website itself is hosted.
  15. User rights recognised under art. 7 of the Code
    "Article 7 Right of access to personal data and other rights"
    1.The data subject has the right to receive confirmation as to whether or not the Personal Data concerning him/her exist, even if not yet recorded, and the right to receive communication of such data in an intelligible form.
    2.The data subject is entitled to receive the following information:
    a) the source of the Personal Data;
    b) the purposes and methods of data processing;
    c) the underlying rationale should the processing be carried out with the aid of electronic systems;
    d) the identification data of the Data Controller, the supervisors and the designated representative on Italian soil, whenever appropriate;
    e) the subjects or categories of subjects to whom Personal Data may be disclosed, or who may have access to in their capacity as designated representative on Italian soil, or as data supervisors or processors.
    3. The data subject is entitled to:
    a) update, amend or, if he/she so wishes, supplement the data;
    b) cancel, anonymise or block data processed in breach of the law; this extends to any data not stored for the original purpose for which it was collected and subsequently processed;
    c) confirmation that the operations outlined in previous letters a) and b) have been brought to the attention (also in terms of their contents) of the entities/individuals to whom the data was originally communicated or disclosed; the only exception to this is when doing so proves impossible or requires using methods which are clearly disproportionate in comparison to the user's rights.
    4. The data subject has the right to object in whole or in part:
    a) on legitimate grounds to the processing of personal data even if relevant to the purposes of collection;
    b) to the processing of his/her personal data for the purposes of sending advertising materials, for direct sales or for carrying out market research or business communications.
  16. How to exercise the rights outlined in art. 7 and how to obtain the list of data supervisors
    The data subject is entitled to exercise his/her rights at any moment in time as per art. 7 of the Code and he/she is likewise entitled to obtain a full list of data supervisors by sending an email to the Data Controller's email address info@baschild.com or by sending a letter by regular mail to the Data Controller's address: BASCHILD S.R.L., Via degli Assini 14/16/18, 24048, Treviolo (BG), Italy.
    Moreover, even if he/she has provided his/her consent, the user may object to data processing for the purposes outlined at point 15.3 by replying to the email received at the address which he/she indicated when providing his/her consent or by clicking the specific link, included in the received email.
